Terms of Service

Ethane ("we," "our," or "us") provides a web-hosted interface that can be used to interact with various decentralized finance protocols and smart contracts. Our services include but are not restricted to our web application, APIs, and related blockchain infrastructure (collectively, the "Service"). The Service is primarily accessed through our website at ethane.app (the "Platform").

These Terms of Service (the "Terms") set forth the terms and conditions governing your access to and use of the Platform and Service, and form a legally binding agreement between us and you ("you," "your," or "User"). By accessing or using the Platform or Service in any manner, you expressly acknowledge and agree to be bound by these Terms. If you do not agree, do not use the Service.

These Terms incorporate our Privacy Policy by reference. By agreeing to these Terms you also consent to the collection, use, and disclosure of information as described in the Privacy Policy.

Ethane is a non-custodial decentralized application that provides an interface for interacting with on-chain protocols, including:

• Token swaps across EVM-compatible chains and Solana via DEX aggregation
• Cross-chain token bridging
• On-chain limit orders
• On-chain trading of tokenized instruments
• Token staking and revenue-share programs
• Token discovery and market data
• Portfolio management and performance tracking
• A referral program for earning rewards

The Service is an interface layer that routes interactions to publicly deployed smart contracts and third-party protocols. We do not operate or control the underlying blockchain networks or smart contracts.

To use the Service you must be at least 18 years of age and must not be a "Prohibited Person" — meaning any person or entity that is: (a) subject to economic or trade sanctions administered by any governmental authority, including any designation on a prohibited or restricted parties list such as the U.S. Treasury Department's Specially Designated Nationals list; (b) located in, a resident of, or organized under the laws of any jurisdiction subject to comprehensive sanctions or designated as terrorist-supporting by the United Nations, European Union, United Kingdom, or United States; or (c) owned or controlled by any such person or entity.

By using the Service, you represent and warrant that you meet these requirements. The use of VPNs or other methods to circumvent geographic restrictions is strictly prohibited and constitutes a violation of these Terms. We reserve the right to restrict access to any individual, geographic region, or jurisdiction at any time at our sole discretion.

Compliance with all applicable laws and regulations in your jurisdiction in connection with your use of the Service is solely your responsibility.

To access certain features of the Service you may need to create an account. You agree to keep your account credentials confidential and not allow anyone else to use your account. You must notify us immediately if you become aware of any unauthorized use of your account. You are responsible for all activities that occur under your account.

We reserve the right to suspend or terminate your account if you provide false or inaccurate information, fail to comply with these Terms, or if we determine at our sole discretion that you no longer meet the eligibility criteria set out herein.

Ethane is a non-custodial service. We do not hold, custody, or control your digital assets at any time. All transactions are executed directly from your wallet on-chain. You are solely responsible for the security of your wallet, private keys, and seed phrases.

Loss of your private key or seed phrase means permanent, irrecoverable loss of access to your assets. We cannot restore access to lost wallets or reverse any on-chain transaction.

You may not use the Service to:

• Engage in, facilitate, or promote illegal activity, including money laundering, terrorist financing, fraud, or tax evasion
• Violate any applicable sanctions laws or trade controls
• Manipulate markets, engage in wash trading, or otherwise manipulate any reward or referral program
• Deploy bots, scrapers, or automated tools in a manner that imposes unreasonable load on our infrastructure, without prior written consent
• Reverse-engineer, decompile, or attempt to extract source code from the Service beyond what is permitted under applicable law
• Transmit malware or any code designed to damage or interfere with the Service
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Access or use the Service in any way not expressly permitted by these Terms

Accessing certain aspects of the Service may incur fees, including protocol fees charged by the platform and fees associated with interacting with third-party protocols. These fees are subject to change without notice. Estimated fees will be displayed in the interface prior to transaction confirmation.

In addition to protocol fees, you will incur network gas fees charged by the underlying blockchain. Gas fees are outside our control and vary with network conditions. While the Service aims to provide accurate estimates, these are preliminary and may differ from actual costs. Ethane is not liable for any losses arising from inaccurate fee estimates.

All fees paid on-chain are final and non-refundable once a transaction is confirmed.

The Service may display, include, or make available services, content, data, or applications from third parties, including decentralized exchanges and other decentralized protocols ("Third-Party Services"). We do not endorse any Third-Party Services. Your access to and use of such Third-Party Services is governed solely by the terms and conditions of those services.

We are not responsible for any aspect of Third-Party Services, including their content, accuracy, availability, or how they handle your data. You irrevocably waive any claim against Ethane with respect to Third-Party Services. You acknowledge sole responsibility for and assume all risks arising from your interactions with them, including risks of illiquidity, devaluation, lockup, or loss of assets.

By using the Service, you represent that you have sufficient knowledge and experience to assess and evaluate the risks involved, including a sufficient understanding of blockchain technologies, digital assets, and smart contract systems. You will bear all risks, including loss of amounts paid and the risk that digital assets may have little or no value.

You acknowledge and accept the following risks, among others:

• Price volatility — digital asset prices are highly volatile and you may lose some or all of your capital
• Irreversibility — blockchain transactions are final and cannot be reversed, cancelled, or recovered once confirmed
• Smart contract risk — smart contracts may contain bugs or vulnerabilities; no smart contract is entirely free from risk
• Protocol risk — third-party protocols integrated with the Service may be exploited, hacked, or become unavailable
• Regulatory risk — the regulatory landscape for digital assets is evolving and may adversely affect the availability or legality of the Service in your jurisdiction
• Wallet security — if your private keys or credentials are compromised, your assets may be permanently lost
• Network risk — transactions may fail or be delayed due to blockchain congestion, protocol errors, or other factors outside our control

Digital assets are not deposits or guaranteed by any bank, and are not insured by the FDIC or any other governmental agency. Nothing on the Service constitutes financial, investment, tax, or legal advice, and nothing should be construed as an offer to buy or sell any security or financial product.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

WE MAKE NO REPRESENTATION THAT THE SERVICE IS APPROPRIATE OR AVAILABLE FOR USE IN YOUR JURISDICTION. ANY DISPLAYED PRICING, RATE, OR LIQUIDITY INFORMATION IS NOT GUARANTEED. ACTUAL TRANSACTION EXECUTION DEPENDS ON THE RELEVANT PROTOCOL AND BLOCKCHAIN NETWORK, WHICH ARE NOT CONTROLLED BY US.

UNDER NO CIRCUMSTANCES SHALL ETHANE OR ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOSS OF DIGITAL ASSETS, OR BUSINESS INTERRUPTION — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO ETHANE IN THE THREE-MONTH PERIOD PRECEDING THE CLAIM OR (B) $100 USD.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

You agree to indemnify, defend, and hold harmless Ethane and its affiliates, officers, directors, employees, agents, and representatives from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or third-party right; or (d) any transaction you execute through the Service.

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason — including if we believe you have violated these Terms or applicable law. Upon termination, your right to use the Service ceases immediately.

Provisions of these Terms that by their nature should survive termination — including disclaimers, limitations of liability, indemnification, and governing law — will continue to apply.

These Terms shall be governed by and construed in accordance with applicable law. If you have a dispute with us, please contact us first at admin@ethane.app and we will attempt to resolve it informally.

Any controversy or claim arising out of or relating to these Terms or the Service, or the breach thereof, shall be settled by binding arbitration on an individual basis. You and Ethane each waive the right to participate in a class action lawsuit or class-wide arbitration.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND ETHANE AGREE THAT ANY PROCEEDING TO RESOLVE A DISPUTE WILL BE CONDUCTED ONLY IN YOUR AND OUR INDIVIDUAL CAPACITIES AND NOT AS PART OF ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

We may modify these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you via the Service or by email. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
